The period of validity or duration of these Particular Conditions of Contract shall be the time that they remain published on the aforementioned website and shall be applicable from the moment the User makes use of the website and/or proceeds to contract any products.

6. Modifications

The provider reserves the right to unilaterally modify these Conditions, without this affecting the goods or promotions that were purchased prior to the modification by the User. The User undertakes to read the contracting conditions carefully each time he/she proceeds to contract a product, given that they may have been subject to modification since the last time he/she accessed them.

7. Nullity

If any provision of these Conditions is declared wholly or partly invalid or unenforceable, such invalidity shall only affect that provision or that part of it which is invalid or unenforceable, and the Conditions shall otherwise remain in full force and effect.

8. Subject matter of the contract

The purpose of this contract is to regulate the contractual relationship between the provider and the user when the user accepts the purchase during the online contracting process by means of the mechanisms described below.

The contractual purchase and sale relationship involves the delivery, in exchange for a specific price and publicly displayed on the website, of one or more specific products.

Users may register on the website by clicking on the create account button. To do so, he/she will enter the personal data required as obligatory: name and surname, e-mail address and password. Registration as a user of the shop will give you access to the website, to purchase products and to receive newsletters with information about the company and its products. We send a welcome email.

12. Taxes, currency and shipping costs

The prices indicated for each product include Value Added Tax (VAT) and in all cases shall be expressed in Euro currency (€). These prices, unless expressly stated otherwise, do not include shipping costs or any other additional services and annexes to the product purchased.

The contracting procedure and pre-contractual information is in Spanish and this language will be used to carry out the contract.

14.1 Registration

In order to start the process of contracting products on www.kwappsolares.com, it is not necessary to register as a user, as "purchase as a guest" is available, although registration is recommended for greater control of the process. To register as a user, click on the button that appears on the main page of the website called "create an account" and fill in the mandatory data requested on the page that will appear below.

After registration, the user name and password are assigned automatically, according to the user's choice. The registration system is not equipped with a user verification system during the registration process. Therefore, before activating the user in the system, a welcome message is sent to the email address. Once successfully registered, the user can enter with your username and password to the control panel of your profile to manage all those functions that the provider of the page has made available, such as the section of the account data, my orders and the possibility of exercising the rights A.R.C.O.

To extend an order you can always do so as long as you have not completed the purchase, and you can do so by clicking on the "Continue shopping" button.

To cancel an order after a purchase has been made, the customer may call us or send us an e-mail, if the shipment has already been delivered.

For orders which have already left the premises of kwappsolares.com the courier company will be notified and in this case, the amount refunded to the customer would be full except for the shipping costs derived from the order.

22. Methods or Modalities of payment

Consumers may pay for their purchase using different payment methods:

• SEPA bank transfer
• PayPal
• Payment on a secure platform provided by Redsys for payment by credit/debit card.

In relation to this payment method provided by Redsys, kwappsolares.com will be responsible for the transaction. However, the Redsys platform operates independently of this website and therefore kwappsolares.com will not store the payment details of customers who choose this payment method.

The transaction platform provided by Redsys offers a secure communication mechanism with the client through a secure protocol (SSL) under encrypted communication.

23. Returns of defective, damaged or incorrect products or exercising the right of withdrawal.

Once you have received your order, you can withdraw from your purchase, provided that the product is unused, has its original packaging and manuals, as well as all its original accessories or promotional gifts if any within 14 calendar days after receipt of your order.

The shipping of the returned product shall be at the customer's expense, unless the product is defective, damaged or incorrect. Likewise, in the event of opting for the option of collecting the product at home, the costs of the collection itself shall be borne by the customer.

We remind you that when you make use of your right of withdrawal, the money paid for the product/s purchased will be refunded and will include the amount of the purchase and, if any, the costs of delivery in the least expensive mode of ordinary delivery. Likewise, in the event of opting for the option of collecting the product from your home, the costs of the collection itself shall be borne by the customer.

Items must be accompanied by their original packaging. In this sense, we will not accept the return of products that have been tampered with in any way in their original form or electronic configuration.

In the case of products that require opening and use in order to know if they are working properly, the Provider shall require that the product to be returned is in perfect condition and that it has all its elements, packaging and wrapping in order to accept its return. The Provider shall also ensure that:

1. Has not been misused or neglected, has not been mishandled or mishandled in an improper or reckless manner, and has not been subjected to abnormal or harmful conditions.
2. It has not been involved in any accident or been damaged in any attempt to repair or modify it.
3. Has not been used in a manner contrary to that stated by the manufacturer in the Product instructions.
4. Has not deteriorated through natural wear and tear after receipt.

In the event that the product does not meet any of the above requirements, we may decide, at our discretion, not to repair or replace the product or refund the amount paid and/or we may ask you to reimburse the full costs of transport and servicing, arising at the current standard rates.

We may debit the above costs from your credit or debit card account or use the payment details provided when placing the Order for the refund.

In the event of a defective product, the Provider shall proceed, as appropriate, to repair, replace, reduce the price or terminate the contract, which shall be free of charge for the consumer and user.

In the event that the product or its packaging has been damaged or is not in its original shipping condition, the value of the item will be depreciated. This provision does not affect the consumer's rights under current legislation.

In cases where you consider that at the time of delivery the product does not conform to what is stipulated in the Contract, is a product damaged during shipment, or is incorrect, you should contact us immediately via our contact form, providing details of the product and the damage it suffers, or by phoning +34 951 87 00 19 during our customer service hours as described above or under the heading Customer Service.

Once the return request has been examined, and the appropriate checks have been made, after confirmation via e-mail, we will proceed to collect the product from the place where it was delivered. We will proceed to carefully examine the returned product and we will inform you by e-mail within a reasonable period of time if the product is to be returned or replaced (if applicable).

The return or replacement of the item will be made as soon as possible and, in any case, within 14 calendar days from the date on which we send you an email confirming the return or replacement of the non-conforming item. The amounts paid for products that are returned because of a proven defect or fault will be refunded in full, including the delivery costs incurred in delivering the item to you.

The refund will be made by the same means of payment used to pay for the purchase. The rights recognised by current legislation remain unaffected. The exchange of an article for a different one will not be accepted, in this case, it will have to be returned and a new purchase will have to be made.

• Receive the amount of the customer's purchases, once the transaction has been accepted.
• To reserve title and retain full ownership of the item until full payment by the customer.

26. Limitation of liability

It is the User's responsibility to keep the data supplied to the Provider duly updated. In any case, the Provider disclaims any liability for damages caused as a result of having provided false, insufficient, inaccurate or incorrect information.

Access to the Website does not imply any obligation on the part of the Provider to verify the authenticity, suitability, completeness, accuracy, adequacy and updating of the information provided by the User through the corresponding forms.

The Provider shall not be liable in those cases in which parents, guardians or legal representatives of underage or incapacitated Users authorise access, provision of personal information or use of the Website or the contracting of any products or services provided through the applications or web platform.

It shall be the responsibility of the aforementioned parents, guardians or legal representatives to supervise the access and use of the minor or incapacitated person when contracting the products and services provided through www.kwappsolares.com .

The Provider shall not be liable for any interruptions in electricity or telecommunications services that prevent users from using the services offered.

27. Applicable Law and Jurisdiction

These conditions shall be governed by or interpreted in accordance with Spanish legislation in all matters not expressly established. The provider and the user agree to submit any dispute that may arise from the provision of the products or services covered by these Conditions to the Courts and Tribunals of the user's domicile. In the event that the user is domiciled outside Spain, the provider and the user expressly waive any other forum, submitting to the Courts and Tribunals of the domicile of the OWNER OF THE WEBSITE.
